A growing trend against businesses who owe the IRS back taxes?

I normally would not have focused on this company.  However, with the 20/20 Tax Resolution spinoff, Tax Guard, it creates concern.  Owner of 20/20 Tax Resolution/Tax Guard Tells Lenders About Your IRS Tax Problems?

Now there are two companies that are focused on reporting your tax problems to lenders if you owe back taxes to the IRS.  Both companies can defeat a business’s efforts to correct a past due IRS problems.  If you have an IRS back tax problem that involves factoring you can read about them here:  Company tells lenders if you owe IRS back taxes.

It’s a Catch-22 situation.  If you could get the lending, you could fix your IRS 941 payroll tax problem.  If Tax Guard or CT Lien Services pry into the business tax situation, and expose missing payroll deposits or IRS Notice of Federal Tax Lien, IRS Form 668(y), they could derail your loan efforts. 

IRS Tax Lien Subordination and Factoring

CT Lien seems to be company that has an automated search for tax lien filings on a recurring basis.  This could put your factoring at risk if a tax lien is filed.  The IRS has provisions for subordinating a tax lien for factoring purposes every 45 days to allow factoring companies to continue providing cash flow, but in must be managed proactively and closely.  If you have questions about subordinating IRS tax liens for factoring, you must contact us.  I have never seen anyone accomplish a lien subordination for factoring on their own.

A Tax Resolution Company that Markets via Telemarketing

  • These companies employ other marketing methods to reach out to people in need of IRS back tax help as well, but they also employ outbound call centers to call when an IRS Notice of Federal Tax Lien, IRS Form 668(y) is filed.  If the people who call are professional, polite, non-pressuring, and do not used fear-based contacts, follow the 3 steps below to learn about them.

A Tax Resolution Company that Markets via TV, Internet, Radio & Other Media

  • These companies use media to reach out to people with IRS tax debt troubles.  When you call into these companies, or complete a “contact me” me form on the internet, you will be connected with their people designated to sell their services.  I use this blog to market my services.  Contact me if you’d like a referral.  The same rules apply for these types of companies.  If the people who call are professional, polite, non-pressuring, and do not used fear-based methods, follow the 3 steps below to learn about them.

Lead Companies that Use all the Marketing Methods Listed Above

  • There are TV commercials that are very specific about the threats of IRS collection, highlighting enforced collection action like bank account or home seizures, but will have no company name designated in the ad, just an 800 number to call “if you owe more than $10,000 to the IRS”.  There are websites built that serve the same function.  Usually they are only one page with a “contact me” form that has the same phrasing.  Scare tactics and “if you owe more than $10,000 to the IRS”.  These are lead generation companies that sell your information to the Tax Resolution Companies.  The terms of their contact dictate that the leads must be greater than $10,000.  If the people you contact are very focused on how much you owe, that is a red flag. 
  • Another version of the lead generation tactic:  You will receive mail, after a tax lien is filed.  The envelope and the enclosure look fairly official, and it says something along the lines of “An IRS Tax Lien was recently filed against you in the amount of….”  Then there is usually a boxed or highlighted portion that says “you may be able to settle your IRS tax debt for…”  and it is usually small fraction of the outstanding IRS taxes owed.  There is an 800 contact number, which then plugs your right back into the marketing systems described above. 
  • In other posts I’ve talked about the tremendous pressure that TV, Pay Per Click (the ads you click on in google), and Radio create with companies.  They are paying top dollar for the advertising, so acquiring new clients regardless of outcome is important to keep their business model upright. 
  • This is why I choose only to use this blog, so people can contact me when they are ready to tackle their IRS back taxes, whether it be 941 payroll tax (trust fund), 1040 income tax, or other taxes. 

3 STEP Process if you Need IRS Back Tax Help

STEP 1:  Before you talk to a tax resolution specialist:

In the first call, whether you contacted the tax resolution company or they contacted you, tell them you want some general information about the company and the name of the person who will be representing you for your IRS tax problem before you talk to them and then you will return their call.  They should be happy to provide you with this information via email, fax, or snail mail, whatever you prefer.  If they refuse, or try to ignore your request, and become pushy, threatening, or obnoxious, that is a red flag.  Once you have the name of the person who will represent you, visit the state’s Supreme Court Attorney Search and make sure the attorney is in good standing.  If there are no issues, proceed to STEP 2. 

If you have an IRS emergency caused by an IRS bank levy or seizure, and you know they have to do something now.  (Short read, I promise.)  

STEP 2:  Read Google & BBB Reviews for the Tax Resolution Specialist you are Researching

 Here’s what I would do prior to hiring anyone to help with IRS back taxes:

Google the company name in quotations followed by the word complaints.  Example:  “irs back tax help” complaints

  • Scan the first couple of pages for concerns.  This will usually bring up the tax resolution company bbb review as well. 
  • I usually google the address too.  I have come across multiple companies operating at the same address or the same company at multiple addresses. 
  • Read the entire BBB report.  Ignore the letter grade and focus on complaints.
  • When using the Better Business Bureau to research companies, it is probably best to use the BBB as a “de-selector” rather than a reason to hire someone.  The BBB solicits companies to become a member; so it is relatively easy to remain in good standing and keep an “A” letter grade.  The nature of the tax resolution company is better seen by how many complaints they have accumulated over the last 3 years, which is the standard BBB reporting period.  A good rule of thumb is no more than one complaint per year, or three complaints total.  Size and age of a company are irrelevant.  It really boils down to how they treated their clients during the reporting period.

I had to think about this for a day before I posted, and please chime in here if I’m missing something.  The reason I’m writing about it is because one of the owners (name in the link above) of 20/20 Tax Resolution, is also an owner in Tax Guard.  What has me scratching my head is this:

  • 20/20 Tax Resolution’s stated intent from their website:  “You have tax issues, and it’s our job to solve them. We’ll develop a strategy you can manage and negotiate with the tax authorities on your behalf. After all, you have more important things to focus on like running your life.”  http://www.2020taxresolution.com/index.php
    • This company wants to solve tax problems whether or not a tax lien has been filed.  
  • Tax Guard’s stated intent from their website:  “Tax Guard has a patent-pending solution that allows lenders to foresee exposure in a way never done before–shedding new light on tax compliance well before a tax lien has been filed.”  http://tax-guard.com/
    • This company will tell lenders, before tax liens or tax levies have been executed about business owners tax problems, potentially preventing lending that would solve the IRS tax problem.  
    • Latest Tax Guard blog post, that clearly state it’s position about people who owe back taxes:  http://tax-guard.com/tax-guard-liability-index-abl-report-for-december-2011/  from the blog:  “Another alarming statistic revealed by the Tax Guard Liability Index was a lack of tax liens issued against the most serious offenders.”
  • Those two stated intents for these companies have very contrary results for business owners and individuals who owe back taxes to the IRS.    
  • The owner of tax resolution company; who is supposed to help businesses and people who owe back taxes with those tax problems is now going to tell the world about those tax problems before tax liens even get filed which may prevent them from getting lending that may solve the IRS tax problem?

Pure speculation here, but my guess is they could “taxprac” each loan applicant.  The IRS has a Form 8821”Tax Information Authorization”.  The IRS Form 8821 would allow someone to peek into your IRS Record of Account to see what tax filings are missing, or what taxes are owed or delinquent, 941 payroll, 1120/1065 income, or others.  It seems bad for the business owner who may be trying to get a loan to fix their tax problem. 

This feels like a situation where they get you coming and going.  Sort of a “work for the company, owe the company store” thing.  Maybe that is not accurate.  I would like it not to be.  I do know that I don’t think that people with IRS back tax problems should be used as repeating revenue streams by tax resolution companies.

There are a lot of good tax resolution companies out there.  These two links will help you determine who’s who:

You should not hire IRS past due tax help unless you think there is a good reason.  The real first question, after a tax lien is filed, is not whom to hire, but “IF” you should hire a tax debt resolution company to help if you owe back taxes to the IRS.

Let’s inject some common sense into the tax problem if you are looking for IRS debt help.  Read the link above, it will help you decide “IF” you actually need to hire IRS back tax help.  Have an IRS emergency caused by an IRS bank levy or seizure?  Take the time to read both of these links.  They are focused on your best interests, not a tax resolution company’s.  

  • 20/20 Tax Resolution wants you to hire them if you owe back taxes to the IRS.  However, do not hire the first tax resolution company you call or calls you about your IRS tax problem.  Make them compete for you business with at least one other company who meets the hiring criteria for irs back tax help.
  • When an IRS tax lien (IRS Notice of Federal Tax Lien, IRS Form 668(y)) is filed with the county recorder, it becomes public record.  Then 20/20 Tax Resolution may collect this information and contact businesses and individuals with IRS tax lien filings.

Why are people calling me about an IRS tax lien that has been filed if I owe back taxes?

An IRS tax lien is filed when you owe back taxes, whether it is 941 payroll tax that is overdue, 1040 personal income tax that hasn’t been paid, or other types of taxes as well.  There are companies that monitor those public record IRS tax lien filings.  As soon as the tax liens are filed, they track down your phone number and start calling you to provide help.  The quality of people calling you about your IRS tax problem is greatly varied.  Some are very good and can deliver the results you need.  Some, either by intent or incompetence, cannot.  The link above will help you research anyone who contacts you about owing back taxes.

Their behavior will usually indicate their intentions.  If they call you over and over and try to scare you into hiring them to deal with your back tax problem, that is not a good sign.  Pressure of any kind while you’re trying to figure out what to do means they are more concerned about your money than solving your IRS tax problem.

 If I owe the IRS back taxes, how do these companies work?  

  • Step 1:  Harvest newly filed IRS and state tax liens.  They search the county recorder’s office manually for newly filed IRS tax liens.  They also subscribe to data compilers that find tax liens for them.  
  • Step 2:  Research phone numbers by address, business name, or individual’s name.
  • Step 3:  Turn these past due tax liens over to telemarketers.  These people are your first clue about the company’s intentions.  If they are rude, aggressive, or not capable of understanding your situation, or worse, indifferent to you tax problem, that is a red flag.
  • Step 4:  Telemarketers will turn you over to sales people.  They are called consultants, analysts, or liaisons.  They are sales people of varying quality.  Again, their demeanor means everything.  If they are knowledgeable, patient, and educational, they are probably ok to deal with, but you must still do your homework on them as described above.  If they are pushy, aggressive, obnoxious, or try to scare you.  Big red flag.  Avoid them.  If they treat you badly before you hire them, imagine what it will be like after they have you money.  
  • Step 5:  They will send you a proposal and IRS documents required to represent you.

A quick note on “References”.  Many of these companies will send you pages and pages of references.  No one will ever send you a reference that will say bad things about them.  Do not only call references, they could be their “aunt Jenny”.  Do the research from the link above.  By doing this, you’ll get an unbiased third party opinion about the company you’re researching.  Wouldn’t you rather have an objective opinion rather than someone who may be compensated to speak well of a company?  

  • Step 6:  After the proposal is sent, the sales person will call you.  Here are some statements that are false and are absolute red flags:

“When you hire me, IRS penalties & interest will stop accruing”.  Not true.  Stop talking to these people.

“IRS agents get paid a commission for what they collect from you.”  Not True.  Stop talking to these people.  There are no government employees who get paid on commission.  

“We have a special relationship with the IRS no other company has.”  They don’t.  Stop talking to these people.  

“I have IRS Form XXXX, and they are about to levy/seize your bank account”  This is horribly manipulative and untrue.  Stop talking to these people.  If you feel like you should believe them, at the very least insist on them sending you the IRS code that supports what they are saying.  Or, contact me with their assertions.  I will provide the IRS source that refutes their claim.

Get the name of the actual representative that will be your IRS advocate.  So you can check them out individually.  If they won’t give you the name of the person who will represent you, that is another red flag and they should be avoided.
