There are a lot of good tax resolution companies out there.  These two links will help you tell who’s who:

Apparently, their primary form of marketing mimics IRS documents and disguises their identity.  I think this is my least favorite form of marketing.  Why start out trying to deceive people? 

“There was no company information but only “IRS Federal Tax Lien Notification” and US govt information. When I called the number at the bottom to inquire about why I received this notice, the company was Ideal Tax Solution out of Costa Mesa CA.”

You should not hire IRS past due tax help unless you think there is a good reason.  The real first question, after a tax lien is filed, is not whom to hire, but “IF” you should hire anyone to help if you owe back taxes to the IRS.

Let’s inject some common sense into the tax problem if you are looking for IRS help.  Read the link above, it will help you decide “IF” you actually need to hire IRS back tax help.  Have an IRS emergency caused by an IRS bank levy or seizure?  Take the time to read both of these links.  They are focused on your best interests, not a tax resolution company’s.

  • Accredited 2010, no letter grade as of 4/7/2012
  • 18 complaints as of 4/7/2012.  Up 4 complaints since 2/25/2012.  There should be no more than 3 in three years, let alone 4 in 42 days. 
  • Ideal Tax Solution, Review, BBB, Costa Mesa, CA.  If you read the complaint details, it describes the reason for the jump and what they have promised to do about it. 
  • When using the BBB to research a tax relief company, it is probably best to use the BBB as a “de-selector” rather than a reason to hire a tax resolution company.  The BBB solicits companies to become a member, so it is relatively easy to remain in good standing and keep an “A” letter grade.  The nature of the company is better seen by how many complaints they have accumulated over the last 3 years; which is the standard BBB reporting period.  A good rule of thumb is no more than one complaint per year, or three complaints total.  Size and age of a tax resolution company are irrelevant.  It really boils down to how they treated their clients during the reporting period.  So Ideal Tax Solutions should have less than three complaints total.

If you are treated politely, and Limon, Whitaker, & Morgan’s salesperson is informative and helpful, that is a good sign.  On the flip side, if they say you need to hire them immediately!  No matter what!  And now! And they are insisting you complete their paperwork immediately.  Do not.  I disagree with that notion.  You should not hire IRS past due tax help unless there is a good reason.  The real first question, after a tax lien is filed, is not whom to hire, but “IF” you should hire anyone to help if you owe back taxes to the IRS.

  • How long have they been in business in tax resolution?
  • How long have they been accredited with the BBB?
  • How many complaints have they received?  There should be no more than 3.
  • When using the BBB to research a tax relief firm, it is probably best to use the BBB as a “de-selector” rather than a reason to hire a tax relief company.  The BBB solicits companies to become a member, so it is relatively easy to remain in good standing and keep an “A” letter grade.  The nature of the company is better seen by how many complaints they have accumulated over the last 3 years; which is the standard BBB reporting period.  A good rule of thumb is no more than one complaint per year, or three complaints total.  Size and age of a tax resolution company are irrelevant.  It really boils down to how they treated their clients during the reporting period.

If you are treated politely, and Tax Resolution Institute’s salesperson is informative and helpful, that is a good sign.  On the flip side, if they say you need to hire them immediately!  No matter what!  And now! And they are insisting you complete their paperwork immediately.  Do not.  I disagree with that notion.  You should not hire IRS past due tax help unless there is a good reason.  The real first question, after a tax lien is filed, is not whom to hire, but “IF” you should hire anyone to help if you owe back taxes to the IRS.

Let’s inject some common sense into the tax problem if you are looking for IRS help.  Read the link above, it will help you decide “IF” you actually need to hire IRS back tax help.  No one, including Tax Resolution Institute, should ask you for a credit card number or checking information the first time they call you. That is a telemarketing tactic to force your commitment.  Even if you have an IRS emergency caused by an IRS bank levy or seizure.

  • TRI wants you to hire them if you owe back taxes to the IRS.  However, do not hire the first tax resolution company you call or calls you about your IRS tax problem; especially if they are trying to pressure/intimidate you into doing that immediately.  High pressure sales tactics are being used for a reason. 
  • When an IRS tax lien (IRS Notice of Federal Tax Lien, IRS Form 668(y)) is filed with the county recorder, it becomes public record.  Then Tax Resolution Institute may collect this information and contact businesses and individuals with IRS tax lien filings, or they may not.

You can set up your own IRS Installment Agreement, but be careful!

The goal of the IRS for an Installment Agreement: 

  • Pay the IRS back taxes owed as fast as possible in full.
  • Leave no “wiggle room” for unplanned expenses in your budget.
  • Collect all penalty and interest.

The goal of the taxpayer for an Installment Agreement: 

  • Pay the IRS back taxes owed in a way that makes sense.
  • Make voluntary payments on top of the formal payment. 
  • To use those voluntary payments to eliminate the penalties that can be eliminated.  (This also mitigates other IRS Penalty & Interest growth)
  • To win an abatement of penalty.  (Remove IRS penalty that has already accrued on past due taxes.)

If you have an IRS Installment Agreement that does not make sense:

When it comes to installment agreements, literally, the majority of our work is re-work of installment agreements that people set up on their own and defaulted, or worse, did not default the IRS pay plan, but defaulted a mortgage, or cancelled insurance, or cashed their 401k, etc…  Do not agree to an installment agreement that does not pass the common sense test.  Substituting different problems for your IRS tax problem is not a solution.   Examples:

  • From the outset you know you cannot afford the payments.
  • If you know that you will eventually not be able to afford it, whether it is 6 months down the road or two years.  Draw the line now. 
  • Agreeing to plan causes you to somehow damages your future

If any of these examples of bad IRS problems, there are other alternatives.  See below. 

IRS Installment Agreements for overdue tax (full text) from irs.gov.

“You can make monthly payments through an installment agreement if you’re not financially able to pay your tax debt immediately. However, you will reduce or eliminate the amount of penalties and interest you pay and avoid the fee associated with setting up an installment agreement if you pay your tax bill in full.”  

If you allow the IRS to dictate Installment Agreement terms, here are some general rules of thumb for IRS penalty and interest growth rate:

  • 1 year over due tax:  ~20-25% growth rate.  
  • 2 years over due tax:  ~40% growth rate.
  • 3+ years over due tax:  double the original liability.

“Before you apply:

  • File all required tax returns;” File as soon as possible no matter what.  File even if you can’t pay anything.  The IRS Failure to File penalty grows to 22% over the course of the first year.  
  • “Consider other sources (loan or credit card) to pay your tax debt in full to save money;” Only pursue this if you can pay the tax debt in full.  If you do this and partially pay your past due IRS tax, you’ll end having to pay the loan and deal with ongoing IRS collection efforts for the rest further damaging your cash flow.  
  • “Determine the largest monthly payment you can make ($25 minimum); and” The longest regular IRS Installment Agreement can go is 60 months.  If you need more time, it’s time to consider an IRS Partial Payment Installment Agreement, or an IRS Offer in Compromise (IRS Form 656).  
  • “Know that your future refunds will be applied to your tax debt until it is paid in full.”  They may take state tax refunds as well. 

There are three different versions of installment agreements that can be had

  1. Regular Installment Agreement:  Monthly installment payments that are the same amount every month up to 5 years long.
  2. Seasonal Installment Agreement:  If your business or income is seasonal, you can arrange to have your payments reflect your income.  During your off-season payments can stop or decrease, and during your busy season you make regular payments. 
  3. Tiered Installment Agreement:  For people trying to recover from a significant drop in revenue or income, but expect to ramp cash flow back up over time.  So in year one, you have one regular payment, in year two, the monthly payment jumps up, year three it goes up again, etc…

It is valid to be concerned about the IRS’ actions, and to take action yourself, but a knee jerk reaction could cause greater IRS problems down the road.  When the IRS goes into enforced collection mode, it’s worth taking a measured approach to fix the tax problem.

STEP 1:  Before you have a full discussion with Tax Group Center, Calabasas, CA:

When an IRS tax lien (IRS Notice of Federal Tax Lien, IRS Form 668(y)) is filed with the county recorder, it becomes public record.  Then Tax Group Center collects this information and contacts businesses and individuals with these IRS tax lien filings.

STEP 2:  Read Google & BBB Reviews & Complaints for the Tax Group Center, Calabasas, CA

So after doing a little homework on Google, the Tax Group Center has two addresses:

  • Tax Group Center, Post Falls, ID:  No separate BBB result
  • When using the BBB to research a tax relief company, it is probably best to use the BBB as a “de-selector” rather than a reason to hire a tax resolution company.  The BBB solicits companies to become a member, so it is relatively easy to remain in good standing and keep an “A” letter grade.  The nature of the company is better seen by how many complaints they have accumulated over the last 3 years; which is the standard BBB reporting period.  A good rule of thumb is no more than one complaint per year, or three complaints total.  Size and age of a tax resolution company are irrelevant.  It really boils down to how they treated their clients during the reporting period.

I do not like the number and nature of the complaints filed with the Better Business Bureau.  Nor do I like numerous complaint results on Google.  I personally have not come across anyone who has any experience with them.  I think you could find a lower risk alternative for a tax resolution company.

Tax Network USA’S Marketing Approach for an IRS Tax Problem:  

Whether you contact them or they contact you about an IRS or state tax lien filing, as long as you are treated politely, and Tax Network’s salesperson is informative and helpful, that is a good sign.  On the flip side, if they say you need to hire them immediately!  No matter what!  And now! And they are insisting you complete their paperwork immediately.  Don’t.  I disagree with that notion.  You should not hire IRS past due tax help unless there is a good reason.  The real first question, after a tax lien is filed, is not whom to hire, but “IF” you should hire anyone to help if you owe back taxes to the IRS.  Let’s inject some common sense into the situation.  Read the link above, it will help you decide “IF” you actually need to hire IRS back tax help.  No one, including Tax Network USA, should ask you for a credit card number or checking information the first time they call you. That is a telemarketing tactic to force your commitment.  Even if you have an IRS emergency caused by an IRS bank levy or seizure.

    • IRS cannot revoke their license, so they don’t have to worry about their livelihood if they take on the IRS for you. 
    • Continuing Legal Education Required:  Yes.
    • IRS Back Tax Expert:  Maybe.   
    • Highest level of education Required:  4 years of college, 3 years of post-graduate work (law school), passing the bar exam, and complete ongoing education.
    • They tend to be more specialized in one particular area, make sure the area is exclusively back taxes, and only work on more complicated matters.

    • Continuing Education Required:  Yes.
    • IRS Back Tax Expert:  Maybe.   
    • Highest level of education Required:  None.  Must take ongoing education. 
    • Limitations:  Should be good at filing taxes.  The test they take to get their licensing is about 95% tax preparation.  Because their licensing comes from the IRS, they depend on the IRS approval for their livelihood.  If the IRS yanks their licensing, they could end up working at Burger King. 
    • Should be cheaper labor cost than Attorney or CPA.

Bookkeeper

  • License required:  No.
    • IRS can ignore them.
    • Continuing Education Required:  No.
    • IRS Back Tax Expert:  Doubtful.   
    • Highest level of education Required:  None.

Tax Preparer

  • License required:  Yes, but not yet enforced.
    • IRS can ignore them.
    • Continuing Education Required:  No.
    • IRS Back Tax Expert:  Doubtful.   
    • Highest level of education Required:  None.
    • Limitations:  Cannot represent you before the IRS.
    • Cheapest option in terms of labor.

So who should I use to help me with my IRS back tax problem? 

I recommend an attorney.  Why?  Because it provides you with the most educated person whose main focus of their education and career revolves around argument and negotiating.  Therefore, true advocacy = The best odds. 

If you need someone to prepare taxes, a bookkeeper, Tax Preparer, Enrolled Agent, or CPA would be good.  CPAs can be a crap shoot.  From personal experience, CPAs tend to like numbers more than people, so their powers of persuasion may not be as strong as an attorney. 

All of that being said; one of the best people I’ve ever met at solving tax problems was unlicensed.  She worked for an attorney, but she was very smart, and always won.  She is the exception to the rule.  Of the top five people I’ve met who are the best at this, all are attorneys, none are CPAs, none are EA’s, and #6 is the person I referenced.  Two of those top 5 are who I now use for your IRS tax problem.

One thing I have observed if you hire one of the larger Tax Resolution Companies is that you don’t get to find out who will represent you, and you may end up with an Attorney, a CPA, or an Enrolled Agent with little experience.

  • These companies employ other marketing methods to reach out to people in need of IRS back tax help as well, but they also employ outbound call centers to call when an IRS Notice of Federal Tax Lien, IRS Form 668(y) is filed.  If the people who call are professional, polite, non-pressuring, and do not used fear-based contacts, follow the 3 steps below to learn about them.

A Tax Resolution Company that Markets via TV, Internet, Radio & Other Media

  • These companies use media to reach out to people with IRS tax debt troubles.  When you call into these companies, or complete a “contact me” me form on the internet, you will be connected with their people designated to sell their services.  I use this blog to market my services.  Contact me if you’d like a referral.  The same rules apply for these types of companies.  If the people who call are professional, polite, non-pressuring, and do not used fear-based methods, follow the 3 steps below to learn about them.

Lead Companies that Use all the Marketing Methods Listed Above

  • There are TV commercials that are very specific about the threats of IRS collection, highlighting enforced collection action like bank account or home seizures, but will have no company name designated in the ad, just an 800 number to call “if you owe more than $10,000 to the IRS”.  There are websites built that serve the same function.  Usually they are only one page with a “contact me” form that has the same phrasing.  Scare tactics and “if you owe more than $10,000 to the IRS”.  These are lead generation companies that sell your information to the Tax Resolution Companies.  The terms of their contact dictate that the leads must be greater than $10,000.  If the people you contact are very focused on how much you owe, that is a red flag. 
  • Another version of the lead generation tactic:  You will receive mail, after a tax lien is filed.  The envelope and the enclosure look fairly official, and it says something along the lines of “An IRS Tax Lien was recently filed against you in the amount of….”  Then there is usually a boxed or highlighted portion that says “you may be able to settle your IRS tax debt for…”  and it is usually small fraction of the outstanding IRS taxes owed.  There is an 800 contact number, which then plugs your right back into the marketing systems described above. 
  • In other posts I’ve talked about the tremendous pressure that TV, Pay Per Click (the ads you click on in google), and Radio create with companies.  They are paying top dollar for the advertising, so acquiring new clients regardless of outcome is important to keep their business model upright. 
  • This is why I choose only to use this blog, so people can contact me when they are ready to tackle their IRS back taxes, whether it be 941 payroll tax (trust fund), 1040 income tax, or other taxes. 

3 STEP Process if you Need IRS Back Tax Help

STEP 1:  Before you talk to a tax resolution specialist:

In the first call, whether you contacted the tax resolution company or they contacted you, tell them you want some general information about the company and the name of the person who will be representing you for your IRS tax problem before you talk to them and then you will return their call.  They should be happy to provide you with this information via email, fax, or snail mail, whatever you prefer.  If they refuse, or try to ignore your request, and become pushy, threatening, or obnoxious, that is a red flag.  Once you have the name of the person who will represent you, visit the state’s Supreme Court Attorney Search and make sure the attorney is in good standing.  If there are no issues, proceed to STEP 2. 

If you have an IRS emergency caused by an IRS bank levy or seizure, and you know they have to do something now.  (Short read, I promise.)  

STEP 2:  Read Google & BBB Reviews for the Tax Resolution Specialist you are Researching

 Here’s what I would do prior to hiring anyone to help with IRS back taxes:

Google the company name in quotations followed by the word complaints.  Example:  “irs back tax help” complaints

  • Scan the first couple of pages for concerns.  This will usually bring up the tax resolution company bbb review as well. 
  • I usually google the address too.  I have come across multiple companies operating at the same address or the same company at multiple addresses. 
  • Read the entire BBB report.  Ignore the letter grade and focus on complaints.

From the Executive Summary: 

  • “Meanwhile, globalization of commerce has caused millions of U.S. citizens and non-U.S. citizens abroad and in the U.S., along with hundreds of thousands of small businesses, to become engaged in international economic activity that draws them into the Kafka-esque U.S. international tax regime.” 

Very strong statement from Nina Olson, the tone of this report is more strident than previous years.  The tax code has 3.8 million words in it, and over the last decade the tax code experienced 4,428 changes.  That means the IRS tax code has changed more than once a day, every day, for the last ten years.  No wonder the taxpayer gets caught up in the system, and no wonder the IRS struggles to administrate.  When we are representing clients, we often end up showing new rules and changes to the IRS collection policy to Revenue Officers who were not aware. 

Ever wonder why no one answers the phone or why you are on hold for 45 minutes every time you call?

  • “and despite a huge expansion in the IRS’s workload, congress has reduced the IRS’s funding in each of the last two years.  as a consequence of all these factors, taxpayer service levels have declined.  the IRS is now unable to answer three out of every ten calls it receives from taxpayers seeking to speak with a telephone assistor, and as of the end of fiscal year 2011, nearly half of all taxpayer correspondence in the IRS’s adjustments inventory was taking more than 6½ weeks to answer.”

Yet the IRS Automated Collection System churns on, spitting out tax liens and tax levies.  Those computer generated tax liens and levies then cascade into this: 

  • “the IRS is in danger of implementing its enforcement and compliance initiatives in a manner that fails to provide taxpayers with adequate notice to enable them to understand what actions are being proposed”

It’s been thirteen and a half years since any pro-taxpayer rights legislation has been passed to ensure we are protected and not denied due process during IRS collection efforts.  People don’t believe me when I refer to the IRS as “the world’s largest and most aggressive collection agent”.  It’s true.

  • “the IRS is effectively the accounts receivable department of the federal government.  it collects more than 90 percent of all federal revenue and therefore provides the funds that make all other federal spending possible.  on a budget of about $12.1 billion, the IRS collected about $2.42 trillion in Fy 2011.  in other words, for every $1 that congress appropriated for the IRS, the IRS collected about $200 in return.”

Power Tax Relief Marketing Approach:

If you are treated politely, and the Power Tax sales person is informative and helpful, that is a good sign.  On the flip side, if they say you need to hire them immediately!  No matter what!  And now, and they are insisting you complete their paperwork immediately.  Don’t.  I disagree with that notion.  You should not hire back tax help unless there is a good reason.  The real first question if back taxes are owed to the IRS, is not whom to hire, but “IF” you should hire anyone to help if you owe back taxes.  Let’s inject some common sense into the situation.  Read the link above, it will help you decide “IF”.  No one, including Power Tax Relief, should ask you for a credit card number or checking information the first time you call them. That is a telemarketing call center tactic to force your commitment. 

If you are dealing with the IRS or state about federal tax liens, IRS final notice of intent to levy, or bank levies, don’t hire the first company you call; especially if they are trying to pressure/intimidate you into doing that immediately!  High pressure sales tactics are being used for a reason.

It is valid to be concerned about the IRS’ collection actions, and to take action yourself, but a knee jerk reaction could exacerbate tax problems down the road.  When the IRS or other tax authority goes into enforced collection mode, it’s worth taking a measured approach to fix the problem.  Handling a tax problem is something you want do right, once, the first time.

Before listening to a sales pitch, perform some due diligence as I have below.  It is the best and safest way to make a decision.  If Power Tax Relief’s sales people are not willing to wait for you to do the research, tell them you want some general information about the company and the name the person who will be representing you before you talk to them and then you will return their call.   If they refuse and become pushy, threatening, or obnoxious, that is a red flag.

How does an IRS tax lien or IRS bank levy affect my credit?  

Answer for IRS tax lien:  We have had our clients tell us that it drops the credit score from 50-100 points.  If you have a tax lien filed against you by the IRS, the IRS is required to send the “Notice of Federal Tax Lien” via certified mail to you last known address.  If you address is wrong, they are only required to attempt the delivery.  

Answer for IRS bank levy:  We have not heard of a drop in credit score after an IRS bank levy has occurred.  (If this has happened you should be seeking professional tax help.)  

IRS Back Tax Help and the Better Business Bureau (BBB), evaluating complaints and reviews

The BBB is moving the goal posts a little bit.  Here’s how to adjust.  Please reference bp110 if you have questions.

irs back tax help has always advocated using the Better Business Bureau as one piece of evaluating a tax resolution company if you owe back taxes and need to hire tax help.  In 2013 changes occurred that are important to be aware of. 

1.  The Los Angeles Better Business Bureau’s membership in the national BBB was revoked.  Apparently, each BBB is a franchise.  So some records that were previously available for a back tax company may no longer show up.  Please note the date of the reviews, here, in the irs back tax help blog.

2.  The criteria for filing a complaint in Colorado changed.  Previously you had to have actually done business with a company to file a complaint, and it appears that is no longer a requirement.  You can now file a complaint if you have contact with the company and don’t like the interaction whether or not you hire them. 

Both changes are disappointing because it clouds an already confusing landscape in regard to the tax resolution companies and dilutes the value of the Better Business Bureau reviews for a delinquent tax assistance company. 

These are the two changes with regard to the BBB that can affect your research if back taxes are owed. 

Before you hire anyone, read an opinion on whether or not and when you should hire help for back taxes?

The process for finding a back tax help company remains the same. 

  • Continue to use the BBB for evaluating help for delinquent taxes, it can still be used as a deselector.  If there are more than 5 complaints about services, it’s probably safer to steer clear.  The services in question are their efforts to solve your back tax problem.  Remember these reports cover a three year period only, not the entire life of the tax help company.   
  • Talk to licensed people only.   IRS Enrolled Agents, Attorneys, and CPAs are able to represent you in front of the tax authorities for back taxes.  Get their name and credentials and check with their governing authority to ensure they are in good standing. 
  • Review how long the tax resolution company has been in business.  I’m sure there are representatives and tax resolution companies that are new may do a great job, however, in the interest of self-preservation, choose someone with a traceable track record of tax resolution.
