Why are people calling me about an IRS tax lien that has been filed if I owe back taxes?

This post is about what happens after an IRS tax lien has been filed and you owe past due taxes to the IRS.  Companies will begin to call you to offer tax resolution help.

Why are people calling me about an IRS tax lien that has been filed if I owe back taxes?

An IRS tax lien is filed when you owe back taxes, whether it is 941 payroll tax that is overdue, 1040 personal income tax that hasn’t been paid, or other types of taxes as well.  There are companies that monitor those public record IRS tax lien filings.  As soon as the tax liens are filed, they track down your phone number and start calling you to provide help.  The quality of people calling you about your IRS tax problem is greatly varied.  Some are very good and can deliver the results you need.  Some, either by intent or incompetence, cannot.  The link above will help you research anyone who contacts you about owing back taxes.

Their behavior will usually indicate their intentions.  If they call you over and over and try to scare you into hiring them to deal with your back tax problem, that is not a good sign.  Pressure of any kind while you’re trying to figure out what to do means they are more concerned about your money than solving your IRS tax problem.

 If I owe the IRS back taxes, how do these companies work?  

  • Step 1:  Harvest newly filed IRS and state tax liens.  They search the county recorder’s office manually for newly filed IRS tax liens.  They also subscribe to data compilers that find tax liens for them.  
  • Step 2:  Research phone numbers by address, business name, or individual’s name.
  • Step 3:  Turn these past due tax liens over to telemarketers.  These people are your first clue about the company’s intentions.  If they are rude, aggressive, or not capable of understanding your situation, or worse, indifferent to you tax problem, that is a red flag.
  • Step 4:  Telemarketers will turn you over to sales people.  They are called consultants, analysts, or liaisons.  They are sales people of varying quality.  Again, their demeanor means everything.  If they are knowledgeable, patient, and educational, they are probably ok to deal with, but you must still do your homework on them as described above.  If they are pushy, aggressive, obnoxious, or try to scare you.  Big red flag.  Avoid them.  If they treat you badly before you hire them, imagine what it will be like after they have you money.  
  • Step 5:  They will send you a proposal and IRS documents required to represent you.

A quick note on “References”.  Many of these companies will send you pages and pages of references.  No one will ever send you a reference that will say bad things about them.  Do not only call references, they could be their “aunt Jenny”.  Do the research from the link above.  By doing this, you’ll get an unbiased third party opinion about the company you’re researching.  Wouldn’t you rather have an objective opinion rather than someone who may be compensated to speak well of a company?  

  • Step 6:  After the proposal is sent, the sales person will call you.  Here are some statements that are false and are absolute red flags:

“When you hire me, IRS penalties & interest will stop accruing”.  Not true.  Stop talking to these people.

“IRS agents get paid a commission for what they collect from you.”  Not True.  Stop talking to these people.  There are no government employees who get paid on commission.  

“We have a special relationship with the IRS no other company has.”  They don’t.  Stop talking to these people.  

“I have IRS Form XXXX, and they are about to levy/seize your bank account”  This is horribly manipulative and untrue.  Stop talking to these people.  If you feel like you should believe them, at the very least insist on them sending you the IRS code that supports what they are saying.  Or, contact me with their assertions.  I will provide the IRS source that refutes their claim.

Get the name of the actual representative that will be your IRS advocate.  So you can check them out individually.  If they won’t give you the name of the person who will represent you, that is another red flag and they should be avoided.
