This post is an addendum to the next most recent article, Can I go to jail if I don’t pay my IRS back taxes?.

I decided to add discussion based on a new article that highlights IRS employees receiving bonuses while they have delinquent tax problems.

Here’s the new article, IRS staffers with tax debts eligible for bonuses.  When you read this in the context of the previous article it shows that the IRS makes no mention of sending their own employees to prison for past due tax.  Even politicians, who are angry with the IRS, do not mention Jail as an option being behind on your taxes.  The entire article is about whether or not they get a bonus.

Here’s a quote:  ” “However, the law specifically excludes unintentional tax errors made due to a ‘reasonable cause,’ not to penalize employees for legitimate, unintended errors. The IRS monitors 100 percent of IRS employee tax accounts to identify acts of potential non-compliance and works with employees to ensure prompt payment.”

The takeaway is that if you have a back tax problem, whether it’s overdue 941 payroll taxes, or unpaid 1040s, going to jail is probably not going to happen unless you have criminal intent.  You don’t go to jail for back luck or hard times.

You should take action to fix a back tax problem, since they only get more expensive the longer they go on.

This post is to discuss whether or not you can be arrested for owing back taxes.  A recent article prompted me to write this.  Here’s the article:  Callers Threaten Arrest For Non-Payment Of Back Taxes In IRS Phone Scam.  Since this article there have been others, additionally, there have been radio ads that insinuate the same threat of going to jail for back taxes.  The real answer is, most likely, you will not go to jail if you owe back taxes.

Before we get too far into the discussion:

There are so many things wrong about this scam, let’s take it apart, piece by piece.

From the article:

“It’s being called the largest IRS phone fraud scam targeting taxpayers ever.”

  • “Phone” is the key word here. If you owe back taxes, the IRS will never ask you to pay anything over the phone.   They may ask when and how you intend to pay your back taxes, but they will not ask you to do it with a credit card over the phone.  The same is true of wiring money or paying with a prepaid card.  You are always welcome to go to the local IRS office and make a back tax payment, so if someone is pressuring to do so.  Here is a link to local IRS office locations.  Click on your state and go from there.

“Callers are frequently insulting or hostile and do so in an apparent attempt to scare their potential victim”

  • If you get a call about delinquent IRS tax, you have rights as defined by the Taxpayer Bill of Rights. Specifically, the Right to Quality Service, which says “Taxpayers have the right to receive prompt, courteous, and professional assistance in their dealings with the IRS, to be spoken to in a way they can easily understand, to receive clear and easily understandable communications from the IRS, and to speak to a supervisor about inadequate service.”
  • If you feel bullied or harassed by someone because there is a past due tax debt, you do not need to continue a conversation of that person.

The scam probably originates once a Federal Tax Lien is filed for back taxes owed.  At that point, the scammers have access to a name and address and details on the specific tax periods that are past due as well as the type of taxes owed, whether it’s 941 payroll, 1040s, etc…  Then they call unsuspecting people who have a tax debt and push them into making a non-traceable payment at the threat of being arrested or sent to jail for not paying taxes.

To wrap up, unless you are intentionally defrauding the government (running a tax scam yourself!) you will not go to jail for back taxes.  If you owe taxes because of tough times, you do have an obligation to pay that tax, interest that has accrued on the tax, and IRS penalty (this portion may be negotiable) in a reasonable time frame that does not cause further hardship.

The IRS collection efforts should pass the common sense test.  If you’re not sure, utilize a contact at the local IRS office.  If you owe back taxes and know you’re talking to a legitimate IRS Revenue Officer, and still cannot reach reasonable repayment terms for the overdue taxes, it may be time to hire help to negotiate.  For a referral, please contact irs back tax help.

2014 IRS Fresh Start Initiative

irs back tax help initially discussed the IRS Fresh Start Initiative back in 2012.  The purpose of the program was to expand the options available to pay back overdue taxes.  Lately, there has been a resurgence of radio ads and marketing revolving around the IRS’ program to solve back tax problems.

This is an update on the Fresh Start Initiative if you past due taxes discussion for 2014.

First, here’s the latest update from the IRS 2014 Fresh Start Initiative.  (Updated as of April 10th, 2014)

The federal fresh start initiative for past due taxes affect 3 specific areas:

1.  The threshold for filing of federal tax liens (IRS Form 668y).  The IRS will only file tax liens on amounts over $10,000, but reserves the right to file on smaller amounts if they feel it will aid in the IRS collection process for past due taxes.

2.  IRS Installment Agreements.  You can set up your own  IRS pay plan online if you owe personal income taxes (less than $50,000) and if you owe back 941 payroll taxes (less than $25,000.)

3.  IRS Offer in Compromise (IRS Form 656).  Changes include revised calculations for future income, allowing delinquent taxpayers to pay their student loans, allowing people with IRS tax debt to pay state and local delinquent taxes, and expanding the Allowable Living Expenses allowance category and amount if taxes are owed.  There is also an IRS Offer in Compromise Pre-Qualifier Tool that you can use to see if a tax resolution company is advising the right course of action.

No individual tax resolution company has a special angle on resolving tax problems.  On the other hand, anyone who advertised back tax solutions on TV or radio is spending a tremendous amount of money to place those ads about the IRS Fresh Start Initiative for taxes owed.  A large advertising budget can place stress on a company to take on tax problems or propose a back tax resolution plan that is not in the best interest of the delinquent taxpayer or the IRS.

Overall, there hasn’t been a great deal of change in 2014 to the IRS Fresh Start Initiative.  There have been minor changes for the better.  It seemed worthwhile to discuss the back tax solution programs again since tax resolution company marketing efforts have started to pop back up touting “new” back tax fixes.  The goal of this discussion is to give you a framework for evaluating both the IRS actions in regard to collecting back taxes, and the marketing efforts of a back tax help company.

From the article:  “no other tax lien purchaser in the District has been more aggressive in recent years, buying the liens placed on properties when owners fell behind on their taxes, then charging families thousands in fees to save their homes from foreclosure.”

A business that’s geared towards taking the final step executing a tax lien.  If you’re not sure you can handle a tax lien alone, don’t let it come to this.  Dealing directly with the state or IRS before a private party tries to take your assets is a better way to go.  The both have programs to solve back tax problems, but you must engage to prevent tax seizures.  Engage on your own, or hire someone to help with past due taxes.  Either way, action is better than no action.

 

Dealing with IRS Back Taxes in 2014? Filing Due Dates Have Not Changed.

If you owe past due taxes to the IRS for 2014 (or any year), the 2014 IRS filing season is starting late due to the shutdown but still ends on the regular dates.  (Link goes to IRS.gov page.)

“During the closure, the IRS received 400,000 pieces of correspondence, on top of the 1 million items already being processed before the shutdown.”

Their automated procedures continued as well.  Tax Liens were still filed, and Final Notice of Intent to Levy were still sent out.

Due dates are April 15th for personal 1040 taxes (delinquent or not) and March 15th for corporate returns.  

You can still file an extension, but don’t forget that you are supposed to pay the estimated tax due on the original date (March or April).

If you know you need to get back to being a non-delinquent taxpayer, start now.  Engage a tax professional as early as possible.  If you wait until January or February, most tax professionals will be booked through tax season.

Additionally, if you owe back taxes to the IRS (or state), the time to start is now.  Things can only get worse the more you procrastinate.

Let’s inject some common sense into the tax problem if you are looking for IRS help.  Read the link above, it will help you decide “IF” you actually need to hire IRS back tax help.  Have an IRS emergency caused by an IRS bank levy or seizure?  Take the time to read both of these links.  They are focused on your best interests, not a tax resolution company’s.

  • When using the BBB to research a tax relief company, it is probably best to use the BBB as a “de-selector” rather than a reason to hire a tax resolution company.  The BBB solicits companies to become a member, so it is relatively easy to remain in good standing and keep an “A” letter grade.  The nature of the company is better seen by how many complaints they have accumulated over the last 3 years; which is the standard BBB reporting period.  A good rule of thumb is no more than one complaint per year, or three complaints total.  Size and age of a tax resolution company are irrelevant.  It really boils down to how they treated their clients during the reporting period.  So Arena & Associates should have three or less complaints total.

“The interest rates announced today are computed from the federal short-term rate determined during April 2012 to take effect May 1, 2012, based on daily compounding.

Revenue Ruling 2012-16, announcing the rates of interest, is attached and will appear in Internal Revenue Bulletin No. 2012-26, dated June 25, 2012.”

“The rates will be:

  • three (3) percent for overpayments [two (2) percent in the case of a corporation];
  • three (3) percent for underpayments;
  • five (5) percent for large corporate underpayments; and

one-half (0.5) percent for the portion of a corporate overpayment exceeding $10,000.”

First, last year’s review:  2011 IRS Fresh Start Initiative.

New changes in IRS Collection policy for 2012 are reviewed below.

  1. “Penalty relief Part of the initiative relieves some unemployed taxpayers from failure-to-pay penalties. Penalties are one of the biggest factors a financially distressed taxpayer faces on a tax bill. The Fresh Start Penalty Relief Initiative gives eligible taxpayers a six-month extension to fully pay 2011 taxes. Interest still applies on the 2011 taxes from April 17, 2012 until the tax is paid, but you won’t face failure-to-pay penalties if you pay your tax, interest and any other penalties in full by Oct. 15, 2012.”
  • The first question that comes up is do you have to be unemployed now, or at the time the tax liability was accrued?  Still searching for the answer.
  • This is great news and dovetails exactly with when we have always recommended you seek to hire IRS back tax help.  (When you owe more than $50,000)
  • Before you set up an installment agreement with the IRS through the On-line Payment Agreement (OPA), I really recommend you take the time to read about the “in’s and out’s” of IRS Installment Agreements.
  1. Installment agreements.  “The new threshold for requesting an installment agreement has been raised from $25,000 to $50,000. This option requires limited financial information, meaning far less burden to the taxpayer. The maximum term for streamlined installment agreements has been raised to six years from the current five-year maximum.”
  1. Offer in Compromise:  No official changes to Offer in Compromise (IRS Form 656) for 2012.  (Yet.)

These Collection Financial Standards are only for use with past due IRS taxes.  If you owe the IRS back taxes and you are entering bankruptcy, you must use the US Trustee Program.

You must be aware of these standards prior to submitting your IRS From 433a or 433b Collection Information Statement.  If you’re not, you may be surprised at the results.  Not being aware of your allowable expenses may give the IRS the upper hand in negotiating your repayment of back taxes.  The IRS will compare your submission to these collection standards when determining how you will be able to address the back taxes owed.  I would venture to say the majority of a tax resolution company’s work is renegotiating IRS pay plans that people initially negotiated on their own.  

“Collection Financial Standards are used to help determine a taxpayer’s ability to pay a delinquent tax liability.  Allowable living expenses include those expenses that meet the necessary expense test.   The necessary expense test is defined as expenses that are necessary to provide for a taxpayer’s (and his or her family’s) health and welfare and/or production of income.”

IRS National Collection Standards include food, clothing, and “out-of-pocket” healthcare.

IRS Local Collection Standards that vary by location include housing, utilities, and transportation.

What’s new for 2012 IRS Allowable Expenses?  Improvements for people and businesses who owe back taxes. 

  • The 6 year collection rule.  IRS Installment Agreements can now be as long as 72 months.  Last year, the maximum length of an IRS Installment Agreement was 60 months.  This is a great addition for delinquent taxes when cash flow remains a big concern. 
  • Updates for cable and internet expenses.
  • Additional items were added to the miscellaneous allowance under National Standards for Food, Clothing and Other Items, increasing the amount allowed for miscellaneous expenses.

There is a hidden problem that people don’t always see coming inside IRS allowable expenses, and it revolves around mortgage payments.  I often get the question “Will the IRS take my house/home?”  Generally, no.  What people don’t realize is that the IRS only accepts the allowable expense, which is often below the real mortgage payment in our over-mortgaged, home devalued economy.

Are the Tax Relief Alternatives ads the only way Tax Defense Network advertises?  No.

Before you hire any Tax Resolution Company for your IRS back taxes, perform some quick due diligence.  If more people would research Tax Debt Relief companies before they hire them a lot of pain and heartache could have been avoided.  JK Harris, TaxMasters, Ronni Lynn Deutch, American Tax Relief, et al, would have had a much smaller negative impact on people who owe back taxes.

Interesting stats for 2011 and somewhat contradictory.  IRS acceptance of Offers in Compromise have jumped dramatically.  Is it due to IRS leniency, or because the main offenders of frivolous offer in compromise filers are out of business?  Ronni Lynn Deutch is out of business, J.K. Harris is out of business, and TaxMasters is in bankruptcy.

There has been a large jump in the percentage of accepted Offers in Compromise with no stated equally dramatic change in policy.  By comparison in 2010, only 24% of all offers were accepted.

What Should NOT Happen when I Talk to a Tax Resolution Company?

Whether you call or a tax resolution company calls you, how should you not be treated when you contact a tax debt relief company?

This is a review of how you should not be treated when you come into contact with a Tax Resolution Company.  This primer will help you evaluate who has the skill set, and the intent to help you fix your IRS back taxes.  If you have questions about this post, please reference:  BP103.

Some of this will sound a little obvious, but it’s written from countless stories of how people have been treated in the past. 

1.  You should not be treated badly in any way.  If this happens before you pay them, imagine what it will be like after you’ve hired them to solve your back tax problems?  A tax resolution company should not make you feel:

  • Ashamed because you owe the IRS back taxes
  • Incapable of understanding your IRS back tax problem
  • If you don’t hire them right away that things will get worse immediately
  • That they have a unique relationship with the IRS no other tax debt relief company has.
  • That they have special access to IRS forms that no one else has
  • That they can issue an IRS Notice of Levy against your bank account

2.  A tax resolution company should not:

  • Insist that you hire their tax debt relief services immediately
  • Insist that you complete their tax relief contract and IRS forms and return them prior to doing research on the company
  • Ask for credit card or checking information on the first call.  This is a telemarketing tactic to lock in your commitment to their tax resolution company
  • Refuse to provide licensing credentials for their representatives. 
  • Use high pressure sales “closing” tactics.  Your IRS back tax troubles need careful consideration, not hurry-up antics.
  • Have more than 3 complaints with the BBB
  • Refuse to send you some general information about their tax resolution company and how they solve IRS tax problems
  • Insist you to pay their full fee up front. 

3.  Things a tax debt relief company should not say to you in regard to your IRS tax problems because they are not true:

  • “When you hire my tax resolution company all IRS penalty & interest stop” 
  • “I have IRS Form xxx in my hands, and if you don’t hire me today, you’re bank accounts will be seized”
  • “IRS Revenue Officers get paid commissions when they collect your back taxes”
  • “We have a special relationship with the IRS no other tax resolution company has”
  • “We guarantee you we will get you an IRS penalty abatement”
  • “Once you hire me, you’ll only end up paying 20-40% of what they are trying to collect” This may be true down the road, but no one can tell you that without reviewing a full picture of your finances.

What Should Happen when I Talk to a Tax Debt Relief Company?

Some of this will sound a little obvious, but it’s written from countless stories of how people have been treated in the past. 

1.  Talking to the tax resolution company’s rep should remove your stress, not add to it. 

  • If you feel that fear or pressure are being used to add urgency to your decision, hit the brakes. 

2.  The tax resolution company’s rep should be happy to send some general information to you before you talk to them.  This is especially true if the tax resolution company initiated contact.  This information should include the physical address of the company. 

3.  A tax resolution company should be happy to provide the name of your actual before you have a discussion with them.  You need to know who will represent you if you hire them.  Not all representatives are equally skilled, and there can be wide quality spreads even within the same company.   Will your rep be a licensed attorney, a CPA, or an Enrolled Agent?  Who can represent me if I owe IRS back taxes? 

  • If they won’t provide the name of your actual rep, that’s concerning.   “Too big” is not an excuse.   irs back tax help has been contacted by people who paid a tax resolution company thousands of dollars, and then found out that their back tax representation had a suspended license. 

4.  Tax debt relief companies put a lot of money into training their representatives.  In your discussions about the overdue taxes, do you get the feeling that their spending money on sales tactics, or are they knowledgeable about your IRS tax problem?  The tax resolution company salesperson should be patient, knowledgeable, polite, and helpful.

5.  A tax debt relief company should explain all of the options to fix IRS back tax problems.  For all past due IRS tax problems, an Installment Agreement (IRS Form 433d), Offer in Compromise (IRS Form 656), and a Partial Payment Installment Agreement should all be explored.  If it for 941 payroll (trust fund) tax, or corporate income 1120 back taxes, business restructuring should also be explored.  If someone is fixated on only discussing one idea, that is concerning.   

6.  The tax debt relief company should be willing to split up your payment to them. Typically over two weeks to thirty days. 

  • If they want you to pay in full up front, the tax resolution company is probably focused more on your money than your IRS tax problem.  Find someone who will be reasonable with you.  This problem won’t be solved over night.

Let’s inject some common sense into the tax problem if you are looking for IRS help.  Read the link above, it will help you decide “IF” you actually need to hire IRS back tax help.  Have an IRS emergency caused by an IRS bank levy or seizure?  Take the time to read both of these links.  They are focused on your best interests, not a tax resolution company’s.

It is valid to be concerned about the IRS’ actions, and to take action yourself, but a knee jerk reaction could cause greater IRS problems down the road.  When the IRS goes into enforced collection mode, it’s worth taking a measured approach to fix the tax problem.

Ideal Tax Solutions’ Better Business Bureau records look like this:

  • In business since 2010
  • Accredited 2010, no letter grade as of 4/7/2012
  • 18 complaints as of 4/7/2012.  Up 4 complaints since 2/25/2012.  There should be no more than 3 in three years, let alone 4 in 42 days. 
  • Ideal Tax Solution, Review, BBB, Costa Mesa, CA.  If you read the complaint details, it describes the reason for the jump and what they have promised to do about it. 
  • When using the BBB to research a tax relief company, it is probably best to use the BBB as a “de-selector” rather than a reason to hire a tax resolution company.  The BBB solicits companies to become a member, so it is relatively easy to remain in good standing and keep an “A” letter grade.  The nature of the company is better seen by how many complaints they have accumulated over the last 3 years; which is the standard BBB reporting period.  A good rule of thumb is no more than one complaint per year, or three complaints total.  Size and age of a tax resolution company are irrelevant.  It really boils down to how they treated their clients during the reporting period.  So Ideal Tax Solutions should have less than three complaints total.

2Q 2012 IRS Interest Rates for Past Due Tax

IRS Interest rates will stay the same for the second quarter of 2012, starting April 1st, 2012.

“The rates will be:

  • three (3) percent for overpayments (two (2) percent in the case of a corporation);
  • three (3) percent for underpayments;
  • five (5) percent for large corporate underpayments; and

one-half (0.5) percent for the portion of a corporate overpayment exceeding $10,000.”

“The interest rates announced today are computed from the federal short-term rate during January 1, 2012 to take effect February 1, 2012, based on daily compounding.”

IRS penalty is the far bigger portion of the growth rate if you owe the IRS back taxes.
